as already noted, more often than not these firms will donate the fee award to some charity. maybe they'll donate it to something helping the schools. they will often, however, try to recoup their out of pocket expenses from the award and not give that back.
at the end of the day the firm winds up ahead, maybe, because they would have probably been donating money out of potential profits to various charities anyway and the ABA, et al. wants them to devote 3-5% of their time to pro bono anyway. It's simply a cost of doing business.
paying a million dollar legal fee award should provide some disincenitve to fighting an injunctive case like this for so many years. if the seattle city legal department couldn't handle this and needed to shell out almost $500k to outside counsel, maybe the city should have considered the value of fighting this and not reaching a compromise. (admittedly, i do not know the specifics of the case...)
