The fact is that firms often collect fees when they win cases that are described as "pro bono." Often, they collect them from some big corporation or the federal government. Generally, nobody bats an eye. In those cases it comes from (if you feel like slanting things) either the poor retirees, widows and orphans who invested all their life savings in the company's stock, or from the taxpayers. This situation isn't really different, it's just closer to home.
One version of a "fair" resolution might be to have the lawyers who lost the case give back all the fees they've been paid, and then have each school board member kick in a pro rata share of DWT's fees. Then the district will wind up ahead, and "the kids" will all be happy. Obviously, neither is going to happen.
